中国刑事辩护词语言特点的顺应性研究

【摘要】：
刑事辩护词作为具有辩护功能的法律文书主要是为了实现三个基本目标:依据法律和事实驳斥对被告的指控,建构事实真相并以此说服审判人员做出有利于被告的判决。其中辩护词的最终目的在于说服,因为其辩护功能只有在得到人民法院的采纳之后才能生效。
本文采用Verschueren的语言顺应理论从语境顺应、语言结构顺应和意识程度顺应三个维度分析了中国刑事辩护词的语言特点。运用定性分析的方法,以辩护词的书面形式为研究对象,分析发现:语境的顺应性主要体现在辩护词中的称呼语的选用,来强调庭审参与者的社会角色与主要职责,为实现刑事辩护词的说服目的打下基础。语言结构的顺应性主要集中在刑事辩护词的措辞、句子结构和文章整体的衔接与连贯的分析上,通过对语码、语言风格和句子类型的选择使辩护词的表达简明清晰、合乎逻辑,客观的反映案件的本来面目,为法官依法公正的做出裁决提供有力的依据。意识程度的顺应性体现在刑事辩护词中所用的元语言意识指示词,以此可以有效表达辩护律师对案件的个人看法和建议,使法官聆听乃至接受自己的辩护意见。
本文尝试运用语言顺应理论对中国刑事辩护词的语言特点进行多维度的分析,希望能为刑事辩护词的学习和写作提供一定程度的借鉴和指导并丰富语言顺应论的应用范围,利用语言学知识为法律实务的开展进行服务。
