当前社会和经济背景下,我国劳资纠纷呈现出“群体性”、“突发性”和“暴力性”特点,员工集体消极怠工、上访、罢工、高管突发离职、员工突然伤亡、精神病过激行为、斗殴、报复伤害、冲击办公场所、拘禁管理人员、散布不良言论等事件屡见报端。其中“突发性”这一特点往往令企业猝不及防、措手不及,而且这一特点经常与“群体性”和“暴力性”等特点交织在一起,使得企业在劳资关系管理尤其是劳资事件处置方面面临严峻挑战。

In the current social and economic background, the labor disputes in our country feature group of employees, emergency and violence. The papers frequently report events of collectively slacking off in work, appealing to higher government body, strikes, abrupt departure of key executives, sudden casualties of employees, aggressive behaviours of psychopathic employees, fighting, injury for vengeance, destroy on working offices, detention of the managerial personnel, spreading unproper remarks. Among the events, the emergency ones, which are usually group events and mixed with violence, assault the enterprises unprepared, and upon which the enterprises will be confronted with the stringent challenge in the labor management, in particular the handling of events of labor disputes.
What is the regular
pattern of the emergency events of labor disputes? What is the
attitude of the government for such events? What shall be early
warning mechanism on the part of the enterprises? What are the
differences between the individual and group events of labor
disputes? How to formulate an emergency preplan? How to respond to
the emergency with an effective solution? Nowadays, such questions
